The patent violations appear to be in the area of the mobile PHR part of the technology used by Quest with the Gazelle platform. Below the patent in question is listed. Some companies have signed license agreements with MMR, and again I’m not a patent expert at all but have been following the what is happening here. Back at the end of last year I talked with CEO Bob Lorsch for an explanation as to what is happening and just to find out a little bit more for my own knowledge and readers of this blog. Quest Care 360 has had the availability for quite a while now for patients to be able to access their lab records. Back in time I remember the doctors had to give permission for some of this to happen for the patient but with the Gazelle platform it seems to be more open access for patients to get their lab results.
Labs is the core business of Quest as we all know and the company made their entry into the electronic medical records business a number of years ago, you find that in the archives here on this blog. Before the medical records business took off they had a document storage business as well which I remember from the early MedPlus days. The Gazelle mobile platform allows sharing for the patient with doctors using mail and fax technologies and if you have read prior articles or the patent information, this is where the violations appear to be founded. Walgreens recently was also issued a complaint for patient violations last month. You can read the entire press release at the link at the bottom of this post. BD
LOS ANGELES, CA -- (Marketwired) -- 04/11/13 -- MyMedicalRecords, Inc. ("MMR"), a wholly owned subsidiary of MMRGlobal, Inc. (OTCQB: MMRF), today announced the filing of a complaint for patent infringement against Quest Diagnostics, Inc. The complaint alleges that Quest is infringing on MMR's Personal Health Records patent, specifically, U.S. Patent No. 8,301,466, and as a result, MMR is seeking monetary damages as well as a permanent injunction. The complaint was filed in the United States District Court for the Central District of California, case number CV-13-2538-CBM (MNx), on April 10, 2013 and is available on the court's website http://www.pacer.gov/. As stated in the complaint, pursuant to its public records and statements, Quest is "the world's leading provider of diagnostic testing services with a medical and scientific staff of approximately 900 MDs and PhDs, an extensive network of convenient patient locations and laboratories and a range of complementary diagnostic products."
